BY CREATING AN ACCOUNT OR USING SYML | Ai SERVICES, YOU ("CUSTOMER," "YOU," OR "YOUR") AGREE TO BE BOUND BY THESE TERMS OF SERVICE. PLEASE READ THEM CAREFULLY.

1. Agreement Overview

These Terms of Service ("Terms") govern your use of the SYML | Ai platform, including all loan origination tools, document analysis features, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy.

SYML | Ai is operated by SYML Software ("SYML," "we," "us," or "our"). If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

SYML | Ai provides an AI-powered loan origination process management platform designed for mortgage professionals. The Service assists with key aspects of the loan origination workflow, including:

• Asset Review: Analyze bank statements and financial documents to verify assets
• Income Analysis: Review and validate income documentation
• Credit Evaluation: Assist with credit report analysis and assessment
• Loan Structuring: Support loan structuring decisions with data-driven insights
• Document Processing: Upload, scan, and extract data from loan file documents

The Service is intended as a professional tool to assist mortgage professionals with the loan origination process. It does not replace professional judgment, regulatory compliance obligations, or lending decisions. All analysis results should be independently verified by qualified personnel before making lending decisions.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You must be at least 18 years old and legally able to enter into contracts to use the Service.

4. Beta Program Terms

During our beta period, the following terms apply:

• Beta access is provided free of charge to the first 50 testers
• Beta testers receive up to 100 pages of document scans
• The Service is provided "as-is" and may contain bugs or errors
• We may modify, suspend, or discontinue beta features at any time
• Beta testers agree to provide feedback when requested

Full pricing and subscription terms will be announced after the beta period concludes.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Upload documents you do not have authorization to process
• Use the Service to commit fraud or any illegal activity
• Attempt to reverse engineer, decompile, or hack the Service
• Share your account credentials with unauthorized parties
• Overload, disrupt, or interfere with the Service infrastructure
• Use automated scripts or bots to access the Service
• Resell, sublicense, or redistribute access to the Service

6. Customer Data

6.1 Ownership

You retain all ownership rights to the documents and data you upload to the Service ("Customer Data"). By uploading Customer Data, you grant us a limited license to process it solely for the purpose of providing the Service.

6.2 Sensitive Financial Information

The Service processes loan origination documents including bank statements, income records, and credit information, which contain sensitive financial and personal information. You represent that you have proper authorization to upload and process any documents submitted to the Service. You are responsible for compliance with all applicable privacy, data protection, and lending laws including but not limited to GLBA, ECOA, and state licensing requirements.

6.3 Data Retention

Please refer to our Privacy Policy for information about how we handle, store, and retain Customer Data.

7. Intellectual Property

The Service, including its software, design, algorithms, and documentation, is owned by SYML and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Analysis results will be 100% accurate or complete
• The Service will meet your specific requirements
• Any defects will be corrected

THE SERVICE IS A TOOL TO ASSIST MORTGAGE PROFESSIONALS WITH LOAN ORIGINATION PROCESSES. ALL ANALYSIS RESULTS SHOULD BE INDEPENDENTLY VERIFIED. YOU ARE SOLELY RESPONSIBLE FOR ALL LENDING DECISIONS, REGULATORY COMPLIANCE, AND UNDERWRITING CONCLUSIONS MADE USING SERVICE OUTPUT. SYML | Ai DOES NOT MAKE LENDING DECISIONS OR PROVIDE LEGAL, FINANCIAL, OR COMPLIANCE ADVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYML SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Loss of data or data corruption
• Errors in loan decisions made using Service output
• Third-party claims arising from your use of the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless SYML and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Documents you upload without proper authorization

11. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access if:

• You violate these Terms
• We are required to do so by law
• We discontinue the Service

Upon termination, your right to use the Service ends immediately. We may retain certain data as required by law or for legitimate business purposes as described in our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law
